Addressing the concerns being voiced over the bulldozer Raj that has become the order of the day in different states, the Supreme Court of India is set to establish nationwide guidelines for the demolition of properties. These guidelines aim to ensure that demolitions are conducted fairly and uniformly across the country, regardless of the community or religion involved.

Here are some key points from the proposed guidelines:

Legal Procedures: Proper legal procedures must be followed before any demolition. This includes providing prior notice through registered post and allowing a reasonable window for contesting the demolition orders.

No Discrimination: The guidelines will emphasize that demolitions should not target specific properties or individuals based on accusations or convictions. Merely being accused or convicted of a crime cannot justify the demolition of a person’s house or property.

Videography and Accountability: There may be a requirement for mandatory videography of demolitions to ensure transparency. Additionally, officers could be held accountable, with compensation for unjust demolitions being recovered from them.

Uniform Application: The guidelines will apply uniformly across all communities and religions, reinforcing the secular nature of the country.

Protection of Public Interest: While unauthorized constructions need to be addressed, the guidelines will ensure that demolitions are not arbitrary and that public safety and interest are prioritized.
